Welcome to Marker Marketplace. By accessing our website at www.markermarketplace.com or placing an order with us, you agree to be bound by these Terms of Service. Please read them carefully before placing your order.

1. Acceptance of Terms

By browsing, accessing, or purchasing from Marker Marketplace, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, please do not use our website or services.

2. Orders and Contract Formation

By placing an order through Marker Marketplace, you agree to the terms outlined below. A contract is formed when we send you an order confirmation. We reserve the right to refuse or cancel any order at our discretion.

3. Cancellations

Custom orders may be cancelled at no charge before proof approval. Once design work has begun, a cancelled custom order is subject to a 20% design fee, reflecting the design work already completed. Stock (non-custom) orders may be cancelled within 1 hour of purchase; after that window, the order enters production and cannot be cancelled.

4. Proofs and Production

Customized products are non-returnable and non-refundable once the customer has approved a proof. Reviewing and approving your proof is your responsibility. Once approved, we are not liable for errors present in the approved proof, including misspellings, incorrect botanical names, or layout choices made by the customer. If an engraving error occurs due to our mistake, we will remake the item at no charge.

5. Lead Times

Standard production time is 5-10 business days after proof approval. Rush service may be available upon request and may incur additional charges.

6. Color Accuracy

Due to differences in screen settings, photography lighting, and material finishes, product colors may appear differently in person than they do on your device.

7. Shipping

Shipping estimates are based on item weight, packaging, and destination. We are not responsible for delays, damage, or loss caused by the shipping carrier. Any issues with delivered packages must be noted with the courier at the time of delivery.

8. Returns and Refunds

Non-custom items may be returned within 14 days of delivery in original condition and original packaging. Shipping charges are non-refundable. Custom, personalized products are not eligible for return once a proof has been approved. See our Return and Refund Policy for full details.

9. Chargebacks and Disputes

We ask customers to contact us directly at service@hrengraving.com before initiating a chargeback with their payment provider. See our full Chargeback Policy for how disputes are handled.

10. Complaints and Disputes

All complaints must be submitted within 30 days of delivery. We reserve the right to inspect any returned items before resolving a dispute. Any resolution will not exceed the original invoice total.

11. Code of Conduct

Marker Marketplace reserves the right to refuse or discontinue service to any customer at any time. Harassment, threats, or inappropriate behavior will result in immediate cancellation of all open orders and a permanent ban from future business.

12. Manufacturer Warranties

Marker Marketplace assumes no responsibility for voided warranties on customer-provided goods that have been engraved or altered.

13. Intellectual Property

All product images, graphics, and content created by Marker Marketplace are protected by copyright and may not be reproduced without written permission. All client-submitted artwork is assumed to be provided with proper licensing. The client agrees to indemnify Marker Marketplace for any legal claims related to unauthorized use of protected designs.

14. Use of Trademarks and Logos

By submitting a logo, emblem, or trademark for engraving, the client affirms that they have legal rights to use and reproduce the material. We reserve the right to display client-submitted artwork in our portfolio unless otherwise requested in writing at the time of order.

15. Pricing and Payment

All prices are listed in US Dollars (USD) and are subject to change without notice. Payment is due at the time of purchase. All transactions are processed securely through our payment providers.

16. Disclaimer of Warranties

Our website and products are provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

17. Limitation of Liability

To the fullest extent permitted by law, Marker Marketplace and its owners, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to that claim.

18. Governing Law

These Terms are governed by the laws of the United States and the state in which Marker Marketplace operates. Any disputes not resolved through good-faith negotiation shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

19. Changes to These Terms

We may update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website constitutes acceptance of the revised Terms.
